SHFT Website & Hardware Terms and Conditions 

Effective Date: December 18, 2025 

These Website & Hardware Terms and Conditions (“Terms”) apply to the purchase of physical SHFT products, including SHFT running Pods (“Products”), made via the SHFT website and webshops operated through Shopify. 

These Terms apply to consumers in both the European Union (EU/EEA) and the United States, with specific consumer rights described in dedicated regional sections below.

2. Scope and Acceptance
By placing an order through the SHFT website, you confirm that you: 

These Terms apply only to the purchase of physical Products. 

Use of the SHFT mobile application and any compatible smartwatch applications is governed by separate App Terms of Service, which must be accepted independently. 

3. Products
SHFT sells physical running Pods designed to be used in combination with software applications. 

The SHFT Pods are intended to be used together with: 

Certain features and functionalities of the Products require connection to and use of a compatible application. 
SHFT does not guarantee full functionality of the Products when used without such applications. 

Products are intended for fitness and wellness purposes only and are not medical devices. 
The Products are not intended for diagnosis, treatment, or prevention of any medical condition. 

4. Orders and Payment 

SHFT reserves the right to refuse or cancel an order in cases of: 

If an order is cancelled after payment, any amounts paid will be refunded without undue delay. 

5. Shipping and Delivery 

SHFT is not responsible for delays caused by carriers, customs processing, or circumstances beyond its reasonable control. 

6. Returns and Refunds (General)

7. EU / EEA Consumers
If you are a consumer residing in the European Union or EEA, the following applies:

You have the right to withdraw from your purchase within 14 days of receiving the Product, without providing any reason.
To exercise this right, you must notify SHFT in writing before the withdrawal period expires. 

7.2 Effects of Withdrawal

You are entitled to remedies for defective Products in accordance with applicable EU consumer protection laws, including repair, replacement, or refund. 

8. US Consumers
If you are a consumer residing in the United States, the following applies: 

8.1 Returns
Return eligibility, timeframes, and instructions are provided at checkout or with the Product. 

8.2 Refunds
Refunds will be issued after the returned Product has been received and inspected. 
Shipping fees are non-refundable unless required by applicable law. 

9. Warranty Disclaimer
To the maximum extent permitted by law: 

This disclaimer does not affect mandatory consumer rights that cannot be excluded by law. 

10. Limitation of Liability
To the maximum extent permitted by law:

• SHFT shall not be liable for indirect, incidental, or consequential damages
• SHFT’s total liability related to any Product shall not exceed the amount paid for that Product 

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
